No Bond for Phelps

During a bond hearing Friday, Dallas County Judge John Porter ruled that there would be no bond for 58-year old James Phelps, one of the two men accused in the strangulation death of 33-year old Cassidy Rainwater near Windyville this summer.

Rainwater was reported missing in September, and authorities say Phelps asked 56-year old Timothy Norton to help him kill Rainwater while she was staying at Phelps home. Norton stated that he held Rainwater down while Phelps strangled her. The pair then dismembered her and placed her in a freezer. Phelps Attorney Morris Wayne Mettler argued that Phelps had no history of violence and deserved a bond, the judge disagreed. Phelps will appear for criminal settings hearing in Dallas County on December 17th. Norton will appear on Tuesday for a criminal setting hearing.
